These Terms of Use ("Terms") govern your use of websites, games, applications, beta programs, and related services operated by Big North Marketing LLC, doing business as Big North Studios ("Big North," "we," "us," or "our").
By accessing or using a Big North service, you agree to these Terms and any game-specific terms that apply to that service. If you do not agree, do not use the service.

1. Who may use our services
Our services are intended for users age 13 and older.
If you are under the age of legal majority where you live, you may use our services only with the permission of a parent or legal guardian who accepts responsibility for your use where required by law.
If local law requires parental or guardian authorization for an online service or for particular data processing, you must have that authorization before using the affected feature.
You may not use our services if doing so would violate applicable law or if we have previously suspended or terminated your access for serious or repeated violations.
2. Accounts
Some services require an account. You agree to provide accurate information, keep your credentials secure, and promptly notify us if you believe your account has been compromised.
You are responsible for activity performed through your account unless applicable law provides otherwise.
You may not sell, transfer, rent, or commercially share an account without our written permission.
We may use account-level limits or eligibility rules to protect game integrity, operate beta programs, prevent abuse, or manage service capacity.
3. Limited license
Subject to these Terms, Big North grants you a personal, limited, revocable, non-exclusive, non-transferable license to access and use the applicable service for your own lawful entertainment purposes.
The service, including its software, game systems, text, artwork, logos, characters, creatures, fictional teams, generated presentation, audiovisual content, and other materials, is owned by Big North or its licensors and is protected by intellectual property laws.
Except as allowed by law or by a feature we expressly provide, you may not:
- copy, sell, sublicense, distribute, or commercially exploit the service or its content;
- reverse engineer, decompile, or attempt to extract source code except where applicable law expressly permits it;
- bypass security, authentication, entitlement, rate-limit, payment, or access controls;
- use bots, scripts, automation, cheats, exploits, or unauthorized software to manipulate gameplay or service operation;
- scrape or systematically extract game data, artwork, generated content, or other service content for a competing database, model-training corpus, commercial product, or resale service without permission;
- interfere with servers, networks, accounts, leaderboards, or other users; or
- use our intellectual property in a way that falsely suggests sponsorship, endorsement, or affiliation.
4. User-provided names and content
Some services allow you to submit limited text, such as a username, callsign, franchise name, team location, team nickname, support message, or similar content.
You retain any rights you already have in content you provide. You grant Big North a limited, worldwide, non-exclusive license to host, process, display, reproduce, and use that content as necessary to operate, secure, moderate, support, and improve the service.
You may not submit content that:
- infringes another person's intellectual property or privacy rights;
- is unlawful, threatening, harassing, hateful, sexually exploitative, or intentionally abusive;
- impersonates another person or falsely claims an official affiliation;
- contains malware, credential theft, spam, or instructions intended to compromise the service; or
- is primarily submitted to disrupt, exploit, or manipulate a game or community feature.
We may remove or refuse content that violates these Terms or creates a reasonable safety, legal, or service-integrity concern.
5. Virtual items and game currencies
A Big North game may include virtual currencies, cards, creatures, upgrades, resources, progression items, entitlements, or other digital game content.
Unless we expressly state otherwise:
- virtual items have no cash value outside the service;
- virtual items are licensed, not sold as personal property;
- virtual items may not be redeemed for legal tender;
- virtual items may not be sold or transferred outside an authorized game feature; and
- game balance, availability, drop rates, progression systems, costs, rewards, and item characteristics may change as the game evolves.
We do not guarantee that any particular virtual item, balance, feature, or progression method will remain unchanged indefinitely.
6. Purchases and subscriptions
Some services may offer paid subscriptions, one-time purchases, or premium features.
Prices and billing periods are shown before purchase. Purchases made through Apple or another platform are also governed by that platform's payment terms.
Where a subscription automatically renews, it will continue until canceled through the applicable billing provider or platform, subject to the terms shown at purchase.
Except where required by law or the applicable platform's rules, purchases are non-refundable after delivery. Big North does not control refund decisions made directly by Apple or another third-party store.
Deleting a game account does not necessarily cancel an active subscription or create a refund. Review the applicable game-specific terms and the subscription-management instructions shown in the service.
7. Beta and test services
A beta, TestFlight build, preview, early-access feature, or other test service may be incomplete and may contain defects, balancing changes, resets, unavailable features, or temporary interruptions.
We may change, suspend, reset, or discontinue beta features or beta data when reasonably necessary for testing, security, or product development. We will try to avoid unnecessary loss of player progress, but beta access does not guarantee permanent preservation of all test data.
Do not rely on a beta service for data that cannot be replaced.
8. Service changes and availability
Games change over time. We may add, modify, rebalance, remove, or replace features, content, rules, providers, or technical systems.
We may temporarily suspend access for maintenance, security, abuse prevention, legal compliance, or technical reasons.
We do not guarantee uninterrupted or error-free operation, permanent availability of every feature, or compatibility with every device or operating-system version.
9. Third-party services
Our services may rely on third parties for authentication, hosting, payments, analytics, email, AI generation, app distribution, or other infrastructure.
Your use of a third-party service may also be subject to that provider's own terms and privacy policy. Big North is not responsible for a third-party service to the extent the issue is outside our reasonable control, subject to rights that cannot be waived under applicable law.
10. Suspension and termination
You may stop using a service at any time and may request or initiate account deletion as described in our Privacy Policy and the applicable service.
We may suspend, restrict, or terminate access if we reasonably believe you have materially violated these Terms, exploited the service, threatened its security or integrity, infringed rights, engaged in fraud, or created a legal or safety risk.
Where practical and appropriate, we may provide notice or an opportunity to correct a violation before permanent termination. Serious abuse, security threats, fraud, or unlawful conduct may result in immediate action.
Sections that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, and dispute provisions, remain in effect after termination.
11. Feedback
If you voluntarily send us ideas, suggestions, bug reports, or other feedback, you grant Big North permission to use that feedback without restriction or compensation to improve or develop our products. This does not transfer ownership of any unrelated intellectual property you include in a support request.
12. Disclaimers
To the maximum extent permitted by law, the services are provided on an "as is" and "as available" basis.
Big North does not warrant that a service will be uninterrupted, error-free, free from all harmful components, or permanently compatible with a particular device, platform, feature, or third-party service.
Game simulations, generated narratives, rankings, scouting reports, fictional journalism, and similar outputs are entertainment features. They are not professional, financial, gambling, medical, legal, or other regulated advice.
Nothing in these Terms excludes warranties or consumer rights that applicable law does not allow us to exclude.
13. Limitation of liability
To the maximum extent permitted by law, Big North and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, or lost data arising from your use of a service.
To the maximum extent permitted by law, Big North's aggregate liability arising out of or relating to a service will not exceed the greater of:
- the amount you paid directly to Big North for the affected service during the 12 months before the event giving rise to the claim; or
- 100 U.S. dollars.
These limitations do not apply where prohibited by law, including where applicable consumer law requires a different remedy or liability standard.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold Big North harmless from third-party claims, losses, or expenses arising from your unlawful use of a service, your material violation of these Terms, or content you knowingly submit in violation of another person's rights.
This section does not require a consumer to indemnify Big North for Big North's own unlawful conduct, negligence, or obligations that cannot be shifted under applicable law.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles, except to the extent mandatory consumer law in your place of residence applies.
Unless applicable law gives you the right to bring a claim elsewhere, disputes arising from these Terms or a Big North service may be brought in the state or federal courts located in Tarrant County, Texas.
Before filing a formal claim, we encourage you to contact bignorthstudios@gmail.com so we can try to resolve the issue informally.
16. Changes to these Terms
We may update these Terms when our services, business, or legal obligations change.
If a change materially affects existing users' rights or obligations, we will provide notice when required by law. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.
17. General terms
If a provision of these Terms is unenforceable, the remaining provisions remain in effect to the extent allowed by law.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
These Terms, our Privacy Policy, and any applicable game-specific terms form the agreement governing your use of the service.
